1. DATA CONFIDENTIALITY AND INFORMATION ON THE PROCESSING OF PERSONAL DATA pursuant to Article 13 of Legislative Decree No. 196/03 and EU Regulation No. 679/16
Dear User,
Pro-M SRL, as Data Controller, pursuant to Article 13 of Legislative Decree 196/03 (Privacy Code) and pursuant to Article 13 of EU Regulation No. 679/2016 (GDPR), hereby informs you that your data will be processed in the following ways and for the following purposes:
1 - OBJECT OF PROCESSING
Your data processed may be of a common, identifying nature (e.g., name, surname, company name, address, telephone number, email address, bank and payment details), and will be processed exclusively for the purposes listed below.
2 - PURPOSE OF DATA PROCESSING
Your data will be processed lawfully and fairly:
A) without your express consent (Article 6, letters b and c, GDPR) for the following purposes:
• Fulfillment of fiscal, administrative, and tax obligations arising from business relationships with us;
• Execution, management, formalization, and termination of existing business relationships (contract administration, orders, shipments, invoice issuance, payments, and/or collections arising therefrom);
• Management of any disputes arising from the existing contract (breach of contract, transactions, debt collection, fraudulent activity);
B) only with your specific and separate consent (Article 7, GDPR) for the following purposes:
• Sending advertising materials and promotional activities;
• Analysis of user behavior, through an automation process, in order to carry out marketing and communication activities in line with their preferences.
Your data will also be processed for the purposes set forth in the applicable anti-money laundering legislation (Legislative Decree 231/2007 and subsequent amendments).
3 - PROCESSING METHODS AND NATURE OF PROVISION
Your data will be processed by the Data Controller, the Data Processors appointed by the Data Controller, and the strictly authorized data processors.
Processing is carried out through collection, recording, organization, storage, consultation, processing, modification, selection, extraction, use, interconnection, communication, and deletion. These operations may be performed using paper, computerized, and electronic means.
Provision of data for the purposes referred to in point 2A is mandatory, while for the purposes referred to in point 2B it is optional, meaning you may decide not to provide any data or subsequently object to the processing of data already provided. Pursuant to and for the purposes of art. 22 of the GDPR, no automated profiling activity is, or will be, carried out as a result of the data acquired following explicit consent for the purposes referred to in point 2.B.
4 - STORAGE PERIODS
Your data will be processed for the time necessary for the aforementioned purposes and retained for a maximum of 10 (ten) years from the termination of the service/product supply relationship.
5 - ACCESS AND DISCLOSURE OF DATA TO THIRD PARTIES
Your data may be accessible to the Data Controller's employees and collaborators in their capacity as internal data processors and/or data processors and/or system administrators, or to third parties who perform outsourced activities on behalf of the Data Controller (professional firms, credit institutions, website management/maintenance providers, and marketing automation companies) in their capacity as external data processors.
For the purposes set out in point 2.B, your data may also be disclosed only to the categories of entities indicated below:
• Postal services or other mail delivery companies;
• Insurance companies;
• Bodies and entities responsible for issuing authorizations or similar, or to which disclosure is required by law for the fulfillment of the aforementioned purposes.
• Inspection bodies responsible for audits and controls regarding compliance with legal requirements.
6 – DATA TRANSFER
The above data will be managed and stored at our registered office and on servers located in Italy and will not be disclosed outside the European Union in compliance with the provisions of the Code. It is understood that the Data Controller, if necessary, will have the right to relocate the servers. In such case, the Data Controller hereby ensures that the transfer will be carried out in compliance with legal provisions and, where necessary, will stipulate agreements with an adequate level of protection.
7 – RIGHTS OF THE INTERESTED PARTY
The interested party may at any time exercise the rights reserved to them, as set forth in Article 7 of Legislative Decree 196/2003 and Article 15 of EU Regulation 679/2016 – Right to access personal data, rectification, erasure, objection, and other rights, as well as the right to lodge a complaint with the Supervisory Authority.
You may exercise your rights at any time by sending a registered letter with acknowledgement of receipt to Pro-M SRL, with registered office at Via V. Vela 1, Bergamo, C/O Studio Buzzetti.
8 – DATA CONTROLLER AND DATA PROCESSOR
The Data Controller is Pro-M SRL, with registered office at Via V. Vela 1, Bergamo, C/O Studio Buzzetti. The updated list of data processors and data processors is kept at the Data Controller's registered office.
2. DELIVERIES AND SHIPPING
The products you purchase are delivered within 1-2 business days from order confirmation. In the event of a delay, our team will contact you.

3. PAYMENTS
Payments for orders can be made by credit card, PayPal, bank transfer, or cash on delivery.
For online payments, we use a data encryption protocol that makes them indecipherable by third parties. Under no circumstances will Pro-M SRL possess your credit card information.

4. RECEIPT AND/OR INVOICING
The invoice will be sent by email within 1 business day of the sale.
5. RIGHT OF WITHDRAWAL / SATISFACTION GUARANTEE
Right of Withdrawal — Terms and Conditions
(Text updated in accordance with Directive 2011/83/EU, implemented in Italy by Legislative Decree 21/2014, which amended the Consumer Code — Legislative Decree 206/2005)
1. Who can exercise the right of withdrawal?
The right of withdrawal is reserved exclusively for consumers, i.e., natural persons purchasing for purposes other than their commercial, entrepreneurial, artisanal, or professional activity.
The following are expressly excluded from the right of withdrawal: retailers, VAT-registered persons purchasing in the course of their business, companies, and, in general, anyone purchasing for commercial or professional purposes. Pro-M SRL reserves the right to request confirmation of consumer status at any time and to verify the nature of the purchase (e.g., quantity, product type, billing information) before accepting the request for withdrawal.
2. Deadline for exercising withdrawal
The consumer has the right to withdraw from the contract, without having to provide a reason, within 14 calendar days.
The deadline begins:
from the day the consumer, or a third party designated by the consumer (other than the courier), acquires physical possession of the goods;
in the case of multiple goods ordered in a single order but delivered separately, from the day the consumer acquires physical possession of the last good;
in the case of delivery in multiple lots or pieces, from the day the consumer acquires physical possession of the last lot or piece.
To meet the deadline, the consumer simply needs to send the withdrawal notice before the 14-day deadline expires.
3. How to exercise withdrawal
The consumer must inform Pro-M SRL of their decision to withdraw by means of an explicit and unequivocal statement, using either:
the standard withdrawal form available at the bottom of this page;
the guided procedure on the website (package icon);
Any other explicit declaration sent to eshop@pro-mstore.com.
Pro-M SRL will promptly confirm receipt of the withdrawal notice on a durable medium (e.g., email).
The burden of proof of having exercised the right of withdrawal within the applicable timeframe lies with the consumer: we therefore recommend using a traceable means (email with receipt, certified email, registered mail) or, in any case, a durable medium.

4. Conditions for returning goods
The consumer may examine and test the goods received to the same extent as in a physical store, for the sole purpose of verifying their nature, characteristics, and functionality (for example, checking components, performing a static test, or briefly testing their functionality). Use of the product beyond this purpose—including, for example, for bicycles, road use for commuting, training, or leisure, the assembly of different components, or the removal of seals or identification labels—does not preclude the right of withdrawal, but will result in the application of the withholding tax referred to in point 6.
The product must be returned, if possible:
in its original packaging;
complete with all accessories, manuals, and packaging;
free of damage not attributable to merely trying on the product.
Pro-M SRL reserves the right to photographically document the condition of the product upon receipt of the return, in order to assess any diminished value.
5. Return Costs
The direct costs of returning the goods are entirely borne by the consumer, unless otherwise communicated in writing by Pro-M SRL. The consumer is advised to inquire in advance about shipping costs, adequate packaging, and, for shipments outside the EU, any customs duties.

6. Refunds and Deductions for Decreased Value
Pro-M SRL will refund all payments received, including standard delivery charges (excluding any additional costs resulting from choosing a more expensive shipping method than the standard one offered), within 14 calendar days of receiving the notice of withdrawal.
Pro-M SRL reserves the right to withhold the refund until the returned goods are received or until the consumer demonstrates having shipped them (providing tracking or proof of shipment), whichever occurs first.
If the returned goods show signs of use exceeding what is necessary to verify their nature, characteristics, and functioning, Pro-M SRL will deduct from the refund an amount corresponding to the estimated decrease in value, quantified based on objective factors such as, but not limited to:
wear and tear of consumable components (tires, brakes, chain, crankset, cables);
aesthetic or functional damage not declared at the time of return;
Absence of accessories, equipment, or original documentation;
Need for restoration, extraordinary cleaning, or reconditioning of the product for resale.
The assessment will be communicated to the consumer, detailing the deducted items. The consumer has the right to contest this assessment by providing supporting evidence.
The refund will be made using the same payment method used for the purchase, unless otherwise expressly agreed, and in any case at no additional cost to the consumer.
7. Cases where the right of withdrawal is excluded
Pursuant to the law, the right of withdrawal does not apply, among others, to the following cases (where applicable to products sold by Pro-M SRL):
Goods made to measure or customized at the consumer's specific request (e.g., custom bike configurations, colors, or customized components made to order);
Sealed goods unsuitable for return due to hygiene or health protection reasons if opened after delivery;
Services already fully performed, if performance began with the consumer's express consent and with the consumer's awareness of the loss of the right of withdrawal upon completion of the service.
8. Legal Guarantee of Conformity
The provisions regarding the legal guarantee of conformity for goods, as well as any commercial guarantees offered by the manufacturer, remain unaffected and are in no way limited by these conditions. For defective products, please contact tech@pro-m.com, attaching photographic documentation of the defect.
9. Jurisdiction and Mandatory Nature
These conditions do not directly or indirectly limit or exclude any rights granted to the consumer by mandatory provisions of law; any clauses to this effect shall be deemed not to apply. For anything not expressly provided for herein, the provisions of the Consumer Code (Legislative Decree 206/2005 and subsequent amendments) and the relevant European legislation apply.
6. WARRANTY
Products are guaranteed by the manufacturers, and the duration of the warranty varies based on the type of product purchased. The applicable warranty date is the one shown on the invoice or receipt.
To claim a warranty on a purchased product, simply contact the manufacturer's Customer Service or our e-shop at tech@pro-m.com. Pro-M SRL undertakes to replace the product (subject to availability) within 10 business days of returning the defective item.
To return the product, please send it via courier, enclosing proof of purchase (printable from your account panel) in the package, to the following address:

We will cover the costs of collecting the defective merchandise and shipping the replacement product.
7. USE OF SERVICES
When registering, the user must provide their name, surname, full postal address, and email address.
The user agrees to provide only true and accurate personal information. Pro-M SRL's services are intended for personal use only.
8. PRODUCT INFORMATION
The photographs on the website illustrating the products are not contractual and therefore cannot constitute any kind of commitment on the part of Pro-M SRL. The technical data sheets and product descriptions are provided to Pro-M SRL by its partners or suppliers; Pro-M SRL therefore declines any responsibility for the accuracy of their content.
9. APPLICABLE LAW
All contracts entered into with us are subject to Italian law. Any disputes shall be subject to the jurisdiction of the Court of Brescia.
