1. DATA CONFIDENTIALITY AND INFORMATION ON THE PROCESSING OF PERSONAL DATA pursuant to Article 13 of Legislative Decree No. 196/03 and EU Regulation No. 679/16

Dear User,
Pro-M SRL, as Data Controller, pursuant to Article 13 of Legislative Decree 196/03 (Privacy Code) and pursuant to Article 13 of EU Regulation No. 679/2016 (GDPR), hereby informs you that your data will be processed in the following ways and for the following purposes:

1 - OBJECT OF PROCESSING

Your data processed may be of a common, identifying nature (e.g., name, surname, company name, address, telephone number, email address, bank and payment details), and will be processed exclusively for the purposes listed below.

2 - PURPOSE OF DATA PROCESSING

Your data will be processed lawfully and fairly:
A) without your express consent (Article 6, letters b and c, GDPR) for the following purposes:
• Fulfillment of fiscal, administrative, and tax obligations arising from business relationships with us;
• Execution, management, formalization, and termination of existing business relationships (contract administration, orders, shipments, invoice issuance, payments, and/or collections arising therefrom);
• Management of any disputes arising from the existing contract (breach of contract, transactions, debt collection, fraudulent activity);

B) only with your specific and separate consent (Article 7, GDPR) for the following purposes:

• Sending advertising materials and promotional activities;

• Analysis of user behavior, through an automation process, in order to carry out marketing and communication activities in line with their preferences.

Your data will also be processed for the purposes set forth in the applicable anti-money laundering legislation (Legislative Decree 231/2007 and subsequent amendments).

3 - PROCESSING METHODS AND NATURE OF PROVISION

Your data will be processed by the Data Controller, the Data Processors appointed by the Data Controller, and the strictly authorized data processors.

Processing is carried out through collection, recording, organization, storage, consultation, processing, modification, selection, extraction, use, interconnection, communication, and deletion. These operations may be performed using paper, computerized, and electronic means.

Provision of data for the purposes referred to in point 2A is mandatory, while for the purposes referred to in point 2B it is optional, meaning you may decide not to provide any data or subsequently object to the processing of data already provided. Pursuant to and for the purposes of art. 22 of the GDPR, no automated profiling activity is, or will be, carried out as a result of the data acquired following explicit consent for the purposes referred to in point 2.B.

4 - STORAGE PERIODS

Your data will be processed for the time necessary for the aforementioned purposes and retained for a maximum of 10 (ten) years from the termination of the service/product supply relationship.

5 - ACCESS AND DISCLOSURE OF DATA TO THIRD PARTIES

Your data may be accessible to the Data Controller's employees and collaborators in their capacity as internal data processors and/or data processors and/or system administrators, or to third parties who perform outsourced activities on behalf of the Data Controller (professional firms, credit institutions, website management/maintenance providers, and marketing automation companies) in their capacity as external data processors.

For the purposes set out in point 2.B, your data may also be disclosed only to the categories of entities indicated below:

• Postal services or other mail delivery companies;

• Insurance companies;

• Bodies and entities responsible for issuing authorizations or similar, or to which disclosure is required by law for the fulfillment of the aforementioned purposes.

• Inspection bodies responsible for audits and controls regarding compliance with legal requirements.

6 – DATA TRANSFER

The above data will be managed and stored at our registered office and on servers located in Italy and will not be disclosed outside the European Union in compliance with the provisions of the Code. It is understood that the Data Controller, if necessary, will have the right to relocate the servers. In such case, the Data Controller hereby ensures that the transfer will be carried out in compliance with legal provisions and, where necessary, will stipulate agreements with an adequate level of protection.

7 – RIGHTS OF THE INTERESTED PARTY

The interested party may at any time exercise the rights reserved to them, as set forth in Article 7 of Legislative Decree 196/2003 and Article 15 of EU Regulation 679/2016 – Right to access personal data, rectification, erasure, objection, and other rights, as well as the right to lodge a complaint with the Supervisory Authority.

You may exercise your rights at any time by sending a registered letter with acknowledgement of receipt to Pro-M SRL, with registered office at Via V. Vela 1, Bergamo, C/O Studio Buzzetti.

8 – DATA CONTROLLER AND DATA PROCESSOR

The Data Controller is Pro-M SRL, with registered office at Via V. Vela 1, Bergamo, C/O Studio Buzzetti. The updated list of data processors and data processors is kept at the Data Controller's registered office.

2. DELIVERIES AND SHIPPING

The products you purchase are delivered within 1-2 business days from order confirmation. In the event of a delay, our team will contact you.

3. PAYMENTS

Payments for orders can be made by credit card, PayPal, bank transfer, or cash on delivery.
For online payments, we use a data encryption protocol that makes them indecipherable by third parties. Under no circumstances will Pro-M SRL possess your credit card information.

4. RECEIPT AND/OR INVOICING

The invoice will be sent by email within 1 business day of the sale.

5. RIGHT OF WITHDRAWAL / SATISFACTION GUARANTEE

Pro-M SRL recognizes the RIGHT OF WITHDRAWAL as provided for by Legislative Decree 206/2005.
The deadline for exercising this right is 14 business days, within which the Customer must notify us by completing the appropriate form in their reserved area. After receiving the RETURN AUTHORIZATION NUMBER by email, carefully package the items, including the number received. Ship the goods, at your own expense, via any courier or by mail to the following address:

To exercise the right of withdrawal, the following conditions must be met:
1. The customer expresses his or her desire to exercise the right of withdrawal as described above;
2. The purchased item must be intact and returned in its original packaging;
3. The item must be returned with a copy of the purchase document or the accompanying invoice or receipt for the purchased products;
4. The product is returned within the timeframe and using the methods described above. The only costs borne by the customer are those related to the return of the product.

Once returned goods reach our warehouse, they will be inspected for any damage (including defects, non-conformities, and/or tampering due to improper use by the customer) not caused by transportation. The refund of the price paid by the Customer for the returned item will be made no later than 10 business days after receipt of the goods. It is understood that the refund amount may be deducted from any damages attributable to the Customer found on the returned product, as well as any return costs (due but not paid by the Customer, including taxes and/or customs duties) incurred by the seller. If the Customer chooses to replace the returned product, we will cover the shipping costs for the new product.

6. WARRANTY

Products are guaranteed by the manufacturers, and the duration of the warranty varies based on the type of product purchased. The applicable warranty date is the one shown on the invoice or receipt.

To claim a warranty on a purchased product, simply contact the manufacturer's Customer Service or our e-shop at tech@pro-m.com. Pro-M SRL undertakes to replace the product (subject to availability) within 10 business days of returning the defective item.

To return the product, please send it via courier, enclosing proof of purchase (printable from your account panel) in the package, to the following address:

We will cover the costs of collecting the defective merchandise and shipping the replacement product.

7. USE OF SERVICES

When registering, the user must provide their name, surname, full postal address, and email address.
The user agrees to provide only true and accurate personal information. Pro-M SRL's services are intended for personal use only.

8. PRODUCT INFORMATION

The photographs on the website illustrating the products are not contractual and therefore cannot constitute any kind of commitment on the part of Pro-M SRL. The technical data sheets and product descriptions are provided to Pro-M SRL by its partners or suppliers; Pro-M SRL therefore declines any responsibility for the accuracy of their content.

9. APPLICABLE LAW

All contracts entered into with us are subject to Italian law. Any disputes shall be subject to the jurisdiction of the Court of Brescia.
