the undersigned company Pro-M S.a.s. Di Biffi Giovanni & C. as Data Controller, pursuant to art. 13 of Legislative Decree 196/03 (Privacy Code) and following Article 13 of EU Regulation No. 679/2016 (GDPR), informs you that your data will be processed in the following ways and for the following purposes:
1 - OBJECT OF THE TREATMENT
Your processed data may be of a common, identifying nature (for example name, surname, company name, address, telephone, e-mail, bank and payment references), and will be processed exclusively for the purposes of the processing listed below.
2 - PURPOSE OF THE TREATMENT
Your data will be processed lawfully and correctly:
A) without your express consent (art.6 lett.b, c GDPR) for the following purposes:
• Execution of fiscal, administrative and tax obligations deriving from the commercial relationships with the writer;
• Execution, management, formalization and closure of the existing commercial relationship (contract administration, orders, shipments, invoice issues, payments and / or proceeds collected);
• Management of any disputes arising from the existing contract (contractual breaches, transactions, debt collection, fraudulent activities);
B) only with your specific and distinct consent (art.7 GDPR) for the following purposes:
• Sending advertising material and promotional activities;
• Analysis of user behaviour, through a process of automation, in order to carry out marketing and communication activities in line with own preferences.
Your data will also be processed for the purposes provided for by the current anti-money laundering legislation (Legislative Decree 231/2007 and subsequent amendments).
3 - PROCESSING METHODS and NATURE OF THE CONFERENCE
Your data will be processed by the Data Controller, by the Data Processors appointed by him and by the strictly authorized processors.
The treatment is carried out by means of collection, registration, organization, conservation, consultation, processing, modification, selection, extraction, use, interconnection, communication, cancellation operations. The operations can be carried out using paper, IT and telematic tools.
The provision of data for the purposes referred to in point 2 A is mandatory while for the purposes referred to in point 2 B it is optional, so you can decide not to provide any data or to subsequently deny the possibility of processing data already provided. It is specified, pursuant to and for the purposes of art. 22 of the GDPR that no automated profiling activity is, that is, will be carried out as a result of the data acquired following the explicit consent for the purposes referred to in point 2 B
4 - STORAGE TIMES
Your data will be processed for the time necessary for the aforementioned purposes and kept for a maximum of 10 (ten) years from the termination of the service / product supply relationship.
5 - ACCESS AND COMMUNICATION OF DATA TO THIRD PARTIES
Your data may be accessible to the employees and collaborators of the Data Controller in their capacity as persons in charge and / or internal managers of the treatment and / or system administrators or to third parties who carry out outsourcing activities on behalf of the Data Controller (professional firms, credit institutions, website management / maintenance provider and and companies for marketing automation processes) in their capacity as external data processors.
Your data, for the purposes referred to in point 2 B, may also be disclosed only to the categories of subjects indicated below:
• Post offices or other mail delivery companies;
• Insurance company;
• Entities and subjects competent to issue authorizations or similar or in any case to whom communication is mandatory by law for the accomplishment of said purposes.
• Inspection bodies / bodies responsible for checks and controls relating to the regularity of legal obligations.
6 - DATA TRANSFER
The above data will be managed and stored at our registered office and on servers located in the Italian territory and will not be disclosed outside the European Union in compliance with the rules of the code. It is understood that the Data Controller, if necessary, will have the right to move the location of the Servers and in this case the Data Controller ensures as of now that the transfer will take place in accordance with the provisions of the law and if necessary stipulating agreements with a level of adequate protection.
7 - DATA SUBJECT'S RIGHTS
The interested party may at any time exercise the rights reserved to him, sanctioned by art. 7 Legislative Decree 196/2003 and art. 15 EU Regulation 679/2016 - Right of access to personal data, of rectification, cancellation, opposition and other rights, as well as the right of complaint to the Guarantor Authority.
You can exercise your rights at any time by sending a registered letter with return receipt to Pro-M S.a.s. with registered office in via V. Vela 1 Bergamo C / O studio Buzzetti.
8 - OWNER AND MANAGER OF TREATMENT
The Data Controller is Pro-M S.a.s., with registered office in via V. Vela 1 Bergamo C / O studio Buzzetti. The updated list of data processors and appointees is kept at the registered office of the Data Controller.
The products you purchase are delivered in 1/2 working days from the moment the purchase is confirmed. In the event of a delay you will be contacted by our team.

Payments for orders can be made by Credit Card, PayPal, Bank Transfer or Countersign.
For online payments we use the HTTPS protocol, a data encryption system that makes them indecipherable by third parties. In no circumstances Pro-M S.a.s. will be in possession of the credit card data.
Any refunds are always made by Pro-M S.a.s. - Via V. Vela, 1 24128 Bergamo - VAT number 12284800153 by bank transfer or Paypal.

The invoice will be sent by email within 1 working day following the sale.
Pro-M S.a.s. recognizes the RIGHT OF WITHDRAWAL as provided by the current legislation D.lgs 206/2005.
The deadline for making use of this right is 14 working days within which the Customer is required to notify us by filling in the appropriate form in the reserved area. Once you have received the RETURN AUTHORISATION NUMBER by e-mail, pack the goods carefully, inserting the number received in the package. Ship the goods, at your own expense, by any courier or by post to the following address:

To exercise the right of withdrawal it is necessary that:
1. the customer expresses his will to exercise the right of withdrawal in the manner described above
2. the goods purchased are intact and returned in their original packaging
3. the goods must be sent back together with a copy of the purchase document or the accompanying invoice or receipt of the products purchased.
4. the product is returned within the times and in the manner described above. The only costs borne by the customer are those relating to the return of the product.
The returned goods, once received at our warehouse, will be examined to verify any damages (including those resulting from defects, non-compliance, and/or tampering due to improper use by the customer) not arising from transportation. The refund of the price paid by the customer for the purchase of the returned item will be made within 10 working days of receiving the goods. It is understood that the refund amount may be deducted for damages attributable to the customer found on the returned product, as well as return costs (due but not paid by the customer, including taxes and/or customs charges) incurred by the seller. In the event the customer opts for the replacement of the returned product, the shipping costs for the new product will be covered by us.

The products are guaranteed by the manufacturers and the duration of the guarantee depending on the type of product purchased. The date on the invoice or tax receipt is binding.
To make use of the warranty on a purchased product, simply contact the manufacturer's Customer Serviceor our e-shop at tech@pro-m.com. Pro-M S.a.s. undertakes to replace the product (subject to availability) within 10 working days after returning the faulty item.

The costs of collecting the defective goods and sending a new product shall be borne by us.
Upon registration, the user must provide name, surname, full postal address and e-mail address.
The user undertakes to provide only true and correct personal information. The services of Pro-M S.a.s. are provided exclusively for personal use.
The photographs on the site to illustrate the products do not enter the contractual field and therefore cannot be the source of any type of commitment on the part of Pro-M S.a.s. The technical data sheets and product descriptions are communicated to Pro-M S.a.s. by its partners or suppliers; Pro-M S.a.s. therefore declines all responsibility for the truthfulness of their content.
All contracts entered into with us are subject to Italian law, for any controversy the Brescia court will have jurisdiction.
